The new law mandates that the New York State Department of Health shall design an informational packet about lymphedema to be given to patients at high risk of developing lymphedema.

The bill was authored by the Lymphatic Education & Research Network (LE&RN) and was spearheaded by NYS Assemblymember Linda B. Rosenthal, who sponsored the bill in the New York State Assembly. NYS Senator Martin J. Golden sponsored the bill in the Senate. The bill also had a champion and advocate in LE&RN Spokesperson Kathy Bates.

"I am deeply grateful to Governor Andrew Cuomo and the New York State Legislature for supporting this bill,” said Ms. Bates. “If not for Bill Repicci and LE&RN’s tireless efforts on behalf of the ten million people suffering from lymphedema in America, none of this would be possible. According to LE&RN, one of the obstacles to LE becoming a national priority has been its low profile among medical practitioners. With medical schools spending little time on the study of lymphatics, doctors are often slow or unable to diagnose LE. As a result, people at risk for the disease are often caught off-guard by the onset of symptoms and lose valuable time in pursuing a treatment regimen. This pioneering bill is a dramatic step forward for patient education in general and is particularly important to the LE community, in which stories of delayed diagnosis and lack of information are all too common. LE&RN has already begun working with LE&RN Chapters across the nation to ensure that all patients receive the same access to information that is now guaranteed for those in New York State.

Tuesday, September 25th, PA Senate leaders did not say yes but also did not say no to passing a bill that would temporarily permit a two-year window for victims of sexual abuse outside of the legal report deadline the chance to file civil suits for their cases. The bill under consideration is in response to the PA Catholic Church sex abuse charges.

Though the Senate did not come to a final decision on Tuesday, they did promise they would decide by the end of October to get the victims of the Catholic church case compensation for the pain they’ve endured. They need more time to choose how that is.

“Anyone who has endured such traumatic pain for so long deserves the ultimate form of compensation,” said Alvin de Levie, Esq. “These poor people have been living with their haunting past and finally have a chance to get the closure they deserve.”

The temporary two-year window would allow child sex abuse victims to report the abuse anytime before their 50th birthday. Those who support the bill argue that this amount of time is needed for some abuse victims to come to terms with the abuse and have the strength to report it.

Senate Majority Leader, Jake Corman, saw some issues with the bill as is when it passed through Senate that he feels should be rechecked and edited. One major issue with the House bill as is is the standard for civil liability for sex abuse happening in public institutions as “gross negligence.”

Corman feels this gives public school employees a shield whereas not one for private schools. "If you're a victim, you don't care if your abuser is a priest or private doctor, or it's a teacher,” he said. Whoever it is he feels should be held equally responsible.

Senate President Pro Tempore Joe Scarnati, R-Jefferson County has discussed his preference to have a fund for the victim’s of the Catholic Church abuse to get compensation without the prolonged litigations inside the courtroom. The House, however, does not feel that is enough arguing this issue goes beyond just this specific case in the church.

The House hopes this bill could benefit any child sex abuse victims who have run out of time or have taken longer to build the strength to report what happened to them. This could break boundaries and possibly prevent child sex offenders from continuing to walk the streets unreported.

Democratic member of the Pennsylvania House of Representatives, Mark Rozzi, is more than willing to hear the Senate’s concerns and offerings about the bill as it stands. He has said all he cares about is helping the victims get justice.

As the bill moves through the Senate, the victims, as well as the House of Representatives, await what could be groundbreaking Legal changes to the way child sexual abuse laws function. The possible adjustment to the age deadline set for filing a case could open the door for many victims too afraid to come forward quickly against their abusers.

Keeping local police out of the picture and no criminal investigation or reporting of these sex crimes to county district attorney’s is how the State is successfully covering-up almost all sex crimes. The State’s MO, if it isn’t documented, it didn’t happen. The cover-ups of sexual assaults and rapes in New York State’s mental health care system overseen by Governor Cuomo are massive in scope and this corruption must be stopped now.

On top of almost all sexual assaults and rapes of our most vulnerable being covered-up, Governor Cuomo and his agencies for years have been unconscionably placing convicted sex offenders in these State and private facilities and group homes. The Commissioners of the Department of Corrections and the Office of People with Developmental Disabilities and anyone else involved are also directly endangering the safety and welfare of incompetent individuals. These agencies are operating almost identically to the Catholic Church in their internal handling of sex crimes.

The State has acknowledged that they have been placing convicted level 2 and level 3 sex offenders that have a clear and known risk of reoffending to live in group homes. The State of New York is attempting to claim that they can protect disabled residents, but that is impossible. Almost all safety and abuse prevention measures are non-existent in these state run or privately operated group homes. Staff are not significantly trained or licensed. Staff themselves are not properly vetted, there basically is no required employment background check. One of the men involved in killing Jonathan Carey, who the foundation is named for, was fired for cause from four prior private facilities before the State of New York hired him. There are no cameras in these group homes to prevent abuse and neglect or ensure swift prosecutions. There is essentially no oversight of these facilities and group homes, they in many cases are a free for all or animal house.

Here is what a convicted sexual predator and pedophile said of Governor Andrew Cuomo’s system, it is “a predators dream.”

"The lack of supervision there made it easy to do what I did," DeProspero said in a handwritten affidavit obtained by The Associated Press. "I could have stayed in that house for years and abused him every day without anybody even noticing at all. It was a predator's dream."

Governor Cuomo, Attorney General Underwood and his agency heads involved continue to remain silent. Numerous calls to stop the placement and immediately remove convicted sex offenders from group homes have been ignored. There is a clear appearance that there is no regard for the safety or equal rights of 1,000,000 New Yorkers with disabilities.

It is time for the top New York State officials involved in these criminal activities and the criminal cover-ups of almost all reported sexual assaults and rapes by Cuomo’s Justice Center abuse hotline to be held accountable. The purposeful placement of convicted sex offenders to live in the same homes with people with disabilities violates State and federal laws, it is illegal. These civil rights atrocities and crimes must be swiftly investigated by the US Department of Justice.
